the legislation says Part 11A of the Environmental Protection Act 1990/April 2000 This statutory provision is designed to tackle the problem of liability for historically contaminated land. The Environmental Agency has been tasked by the Government to identify all such contaminated land. Since the United Kingdom has been an industrial society for in excess of 300 years we have both known and hidden potential pollutants throughout the country. Under the Environmental Protection Act known polluters are responsible for the pollution that they cause. If the known polluters cannot be located, which in the light of our historical society could be a real possibility, then the current owner of the property, or the sitting tenant if the owner cannot be located, would in fact be responsible for the clean-up costs of that land. |
